Terms of Service

You (“Customer”) are contracting with Sweet Stems Flower Preservation (“Sweet Stems”) for floral preservation services and hereby agree to and acknowledge the following terms and conditions:  

FLORAL CONDITON: Customer understands that several factors can affect the quality and color of the flowers including, but not limited to: what condition we receive them in, the quality of the original flower, if they were painted/dyed or sprayed with chemicals, etc. We professionally dry the flowers which will also alter the color, typically flowers dry darker. (whites turn yellow, reds turn maroon, etc.) We cannot guarantee that flowers will retain their original color. Our preservation process involves a thermosetting polymer, which may enhance bruises or translucent spots on the flowers.

Sweet Stems reserves the right to refuse to preserve flowers that arrive wilted, rotten, or damaged as the preservation process will not be successful. Sweet Stems will not be responsible to return the wilted/damaged flowers. For an additional fee, Sweet Stems may agree to assist with replacing your flowers if you choose. Sweet Stems is not responsible for lost, stolen or damaged flowers/bouquets. Sweet stems will not be held liable for anything that occurs during Customer’s event or during transit. Full refunds will not be given for lost, damaged, or stolen flowers as we purchase all necessary material beforehand to prepare for your order. For flowers lost in shipping, we will offer 50% refund if this can be proven with tracking number.

EPOXY RESIN PRODUCTS: Resin will naturally yellow/amber over time. Sweet Stems will not held liable for this natural process. Bubbles are unavoidable, although we take our time to perfect each piece to the best of our ability. Flowers can shift to some degree after being placed in resin. Small debris cannot be avoided entirely in the preservation process.

DRIED FLOWERS: If you send flowers that have been dried elsewhere, Sweet Stems is not responsible for any mold or rot during the preservation process. We cannot preserve dried flowers that still contain any moisture.

ADVERTISEMENT: Customer understands that sweet stems has the rights to photograph all products that are made by Sweet Stems to be used on any media platforms and/or advertisements without limitation from customer.

CANCELLATION POLICY: If Customer requests to cancel an order within 24 hours of placing it, we will issue 100% refund. After 24 hours of placing an order, no refunds will be accepted for any reason. However, you may use this as a credit towards a different order within 1 year of original order date.

RETURNS: All orders are sold “as-is” as cannot be returned.

UNUSED FLOWERS: When designing your piece, we choose the best quality flowers after the drying process. We do not typically have leftover flowers. Any floral not used in your pieces will become the property of Sweet Stems Flower Preservation.

PICK UP: Your order must be picked up at our location within 3 weeks after completion. 30 days after notification of completion all moneys and flowers are considered abandoned, unless other arrangements are made. They will become the property of Sweet Stems.

FAILURE TO SUBMIT PAYMENT: Should sweet stems incur legal expense in connection with any effort to collect monies due hereunder or to defend itself relative to any claims made hereunder, Sweet Stems shall be entitled, to the fullest extent under the law, to reasonable legal fees and costs associated therewith. This contract shall be governed by the applicable provisions of the law of the State of Illinois.

ISSUES WITH ORDER: Any claim you make for any type of damage under this contract shall be made in writing to Sweet Stems within thirty (30) days of delivery of the product you have purchased. Any failure to make a timely written claim shall be deemed a waiver by you.

NATURAL DISASTER: Sweet Stems is not responsible for damage or loss of flowers due to fire, flood, equipment failure or any other acts of God affecting shipment or Sweet Stems. However, Sweet Stems will immediately notify Customer and may offer to refund Customer’s payment or to replace the flowers, at our discretion.

Sweet stems is not liable for any injuries sustained in relation to products.

If any provision of this contract is found to be ineffective or unenforceable for any reason, such provision shall be fully severable, and this contract shall be construed and enforced as if such provision never comprised a part of this contract. The remaining provisions of this contract shall remain in full force and effect and shall not be affected by any ineffective or unenforceable provision or by the severance from this contract.
